Terms & Conditions

Bryan Purves Ltd has been providing specialist car restoration services and parts for many years. The majority of our customers are long-standing and many new customers are recommended by existing customers. The company values our customer  relationships, but in common with all other service companies it is necessary for us to operate strict ‘Terms & Conditions’ covering both the supply of goods and also restoration work undertaken in our workshops.

These conditions apply to the exclusion of any condition whatsoever of the buyer whether implied or expressed.

 

1.Goods

Bryan Purves Ltd (the Company) does not supply goods on a sale or return basis and there is no obligation on the Company to accept returned goods. However, the company, may at its discretion, accept within a period of not more than seven business days, items in an ‘as supplied’ condition, subject to a re-stocking charge of 20% The company is unable to refund any postage costs and the above relates to the original cost of the goods.  However, items that are customer specific, or special order e.g. trim items where the customer has specified colour etc cannot be returned. Payment for items, including postage, is required prior to dispatch.

Prices shown on the Company’s website are correct at the time of display on-line. However, in the unlikely event of either an Administrative error or the need for the Company to acquire further stock to satisfy the customer’s order then we reserve the right to correct the price, in the case of an Administrative error or adjust the price to reflect the company’s own costs from its supplier.,

 

2.Transit

All goods will be despatched via a carrier on a next day delivery where applicable and charged to the customer’s account.  Bryan Purves Ltd always obtains a ‘proof of posting’ but cannot be held responsible for loss or damage of any goods in transit. Should the customer require insurance for the period of transit, the Company should be informed; this will then be arranged and will be charged as an extra supplement.

 

Goods sent by Royal Mail: Royal Mail state 'Allow 20 working days for items to arrive at European destinations and 25 working days for the rest of the world'. (International P58 September 2009).

 

Goods sent to Italy & Portugal will by courier only.

 

3.Placement of Order

The placement of an order is an agreement between the customer and Bryan Purves Ltd. Where possible, an agreed supply price will be stated based upon the current fixed prices as per ‘the Company’ website. Bryan Purves Ltd. reserves the right to amend prices when appropriate. In a situation where the vehicle or parts of are delivered for the preparation and installation of component parts, trim, carpets and weather equipment etc. an exact quotation cannot be given as every situation is different and requires a varying approach. In the event of the discovery of the need for remedial work to be undertaken for example welding, replacement of timbers, framing, straightening panels in order to complete the fitment of trim, panels, covers, etc. Bryan Purves Ltd will undertake this work as required and the additional labour and materials will be charged to the customer. In the event of the discovery of major work to be undertaken the customer will be informed and requested to visit within a period of 5 days to confirm that work may continue. In the event of the customer not being able to visit, the restoration work will commence and chargeable in full to the customer.

 

4.Payment for Goods and Work in Progress

Where Bryan Purves Ltd is commissioned to undertake significant restoration work then a payment schedule will be agreed between the Customer and the Company, prior to any work commencing. In all cases a deposit of 50% for stock items and 100% for non-stock items will be required prior to work commencing. Where there is ongoing work in progress on a vehicle or parts of at our premises, an Invoice will be generated on a monthly basis. Payment of the account must be made within 14 working days of the date of Invoice otherwise interest will be added at 8% above Base Rate (E.U. regulations. August 2002 apply). All goods remain the property of Bryan Purves Ltd. until payment has been made in full against cleared funds.

Please note that we accept payment by both Credit and Debit Card. We charge an additional 2.5% for Credit Card Payments; this is the same charge that we incur from our Bank. Debit Card payments do not incur any additional charge and this is our preferred method of payment.

 

5.Collection of Goods

All goods must be collected within a period of 7 days after notification of the completion of the order. Alternatively the customer will be notified when the goods are ready for despatch and will be shipped within seven days after notification. The Company does not have storage facilities for cars where work has been completed; it is therefore important that vehicles awaiting collection must be removed within 7 days after completion of the work and notification. In the event of non collection of a vehicle, we will make storage arrangements with a ‘third party’ company, whose current charges (April 2010) are £15.00 per day plus VAT. These charges will be added to the final Invoice. All goods and vehicles will only be released against cleared funds.

 

6.Non Collection of Goods (General Lien)

Goods that have not been collected or paid for in full after a period of three months will become the property of Bryan Purves Ltd. If any such lien is not satisfied within the three month period Bryan Purves Ltd. may at the company’s absolute discretion advertise and sell the goods or part thereof. Should there be a profit upon selling the goods over and above the outstanding Invoice the difference will be remitted to the customer less all the incurred expenses.

 

7.Electro- Plating

A six month guarantee is given against the electro-plating process. It is the customer’s responsibility to ensure that the final product is correctly treated, fitted and maintained in a manner that will prevent the progressive degeneration of the finished article. In the event of the loss of small components Bryan Purves Ltd. cannot be held responsible. In many cases upon stripping of the original electro-plating heavy pitting and oxidization can be found. Where major repairs are considered necessary the customer will be notified before further work is undertaken. Where remedial work is required this will be undertaken and charged directly to the customer. The attention of the customer is drawn to the fact that we can only undertake to achieve our best with whatever product we are presented with. This is a restoration process of an old component!

 

8.Insurance

It is the responsibility of the owner of a vehicle entrusted to Bryan Purves Ltd to ensure that the vehicle is comprehensively insured. If individual components have been entrusted to ‘the company’ it is the owners’ responsibility to insure all the items. Many insurance companies require details of the location of cars overnight and it is therefore recommended that the owner informs their insurance company when cars are placed with Bryan Purves Ltd for restoration works. Failure to do this could have an impact on agreed value insurance etc.

Bryan Purves Ltd is fully insured through NIG Insurance but Insurance cover will not necessarily provide agreed value insurance so customers are advised to ensure their own insurance remains in operation whilst their vehicle is located at the Company’s workshops.

 

9.Collection & Delivery of Vehicles

An arrangement can be made with Bryan Purves Ltd for the collection and delivery of a vehicle. A mileage rate will be charged for both directions. In the event of the distance being outside 8 hours driving then overnight accommodation and incurred expenses will be charged to the customer. It is the customer’s responsibility to guarantee the vehicle is comprehensively insured and in the event of an overnight stop Bryan Purves Ltd. cannot be held responsible for theft or damage.

When a vehicle is entrusted to Bryan Purves Ltd a vehicle condition (bodywork) form will need to be completed and signed by both the customer and the Company.

 

10. Economic Operator Registration & Identification

Bryan Purves Ltd has been allocated the EORI Number GB680193432000. A detailed explanation of EORI is available from HM Revenue & Customs.
